Abstract	The article analyzes the deed as a mandatory feature of the objective side of the bribe of the person who provides public services. Substantiated the necessity of exclusion from the Part 1 of Art. 368-4 of the Criminal Code of Ukraine the deed which is in the request for unlawful benefits, due to the mistaken assignment to the actions of the “active” corruptor.
